Start with the L-1A eligibility and application overview
Examine the positions, not just the people’s education
Identify the actual professional duties and entry requirements of the subordinate jobs. An employee can hold a degree while occupying a position that is not professional for the relevant analysis. Conversely, describe genuine professional work accurately instead of reducing it to a generic support title. The evidence should explain the positions and the applicant’s managerial responsibility together.
Show real management rather than ordinary first-line supervision
Explain authority over professional work, relevant personnel decisions and discretionary management responsibilities. Identify the applicant’s own operating tasks and assess whether the role is primarily managerial. A first-line supervisor does not qualify merely by supervising people; the professional nature of the supervised positions matters to that distinction. Consider actual staffing and reasonable organizational needs without inventing a fixed headcount.
Retain the qualifying transfer conditions
Prove the related parent, subsidiary, affiliate or branch organizations, required continuing business in the United States and another country, and qualifying continuous full-time foreign employment for one year within the relevant three-year period. In an ordinary L-1A case, that foreign year may be managerial, executive or specialized-knowledge work. The proposed U.S. duties must independently satisfy the managerial or executive standard.
Apply the relevant office and stay rules
A qualifying U.S. office doing business for less than one year triggers new-office rules. L-1A requires sufficient premises, the qualifying foreign managerial or executive year and support for the U.S. role within one year of approval. Initial new-office approval is limited to one year; ordinary individual initial approval can be up to three years and the general L-1A maximum is seven years, with applicable counting and exceptions. Owner or major-stockholder cases need the appropriate temporary-services and subsequent foreign-assignment evidence.
Managing people and managing a function are different claims
L-1A managerial capacity can be shown in two ways: managing the organization or a department through subordinate supervisors or professionals, or managing an essential function at a senior level with discretion over its day-to-day operations. The petition should state what proportion of the transferee's time will go to managing people or a function, setting policy, hiring and firing, and budget authority, and what proportion to hands-on operational tasks. A manager of the function decides which procedures the company will adopt, assigns audits to site safety coordinators or external consultants, approves training programs, signs off on regulatory submissions prepared by others and answers to the executive team for outcomes. Provide the organisation chart with the subordinates' own roles described, since a manager who supervises other professionals or supervisors is in a very different position from one whose team performs routine work. Organization charts, budgets, delegation policies, payroll records and examples of prior decisions can show who sets goals, allocates resources and evaluates subordinate work. U.S. days do not count toward the foreign year, although qualifying brief trips need not interrupt continuity. The decisive choice is whether the documented structure supports managing a function or personnel rather than permanent hands-on production.
