Start with the L-1B eligibility and application overview
Identify the knowledge behind the instruction
L-1B concerns special knowledge of the organization’s products, services, research, equipment, techniques, management or other interests and their application in international markets, or advanced knowledge of its processes and procedures. Explain what the instructor knows and how that knowledge is used in the U.S. work. A generally effective presenter is not automatically a specialist, and a training title does not replace the knowledge analysis.
Document expertise without inventing exclusivity
Relevant curricula, problem-solving examples and actual internal responsibilities can support an explanation. Identify the applicant’s contribution and the level of knowledge demonstrated. The standard does not universally require proprietary or unique knowledge, but merely distributing a standard manual does not by itself establish special or advanced knowledge. If primarily stationed at an unaffiliated worksite, the employee cannot be principally controlled and supervised by that employer, nor placed essentially as labour for hire rather than in connection with the petitioner’s specialized-knowledge product or service.
Establish the foreign employment independently
Show the qualifying parent, subsidiary, affiliate or branch relationship, continuing business in the United States and another country and the required continuous year of full-time qualifying foreign employment within the relevant three-year period. A recent course date does not automatically become the beginning of every qualifying-employment calculation. Conversely, course attendance alone does not establish the required employment record. That foreign year must be full-time qualifying managerial, executive or specialized-knowledge employment; the U.S. role must use specialized knowledge.
Use the actual office and authorized-stay framework
Ordinary individual initial L-1B approval may be up to three years; the general maximum is five years with applicable counting and exceptions. A U.S. organization doing business for less than one year falls under new-office rules, initially limited to one year, with sufficient premises and financial ability to pay the employee and commence business required. Owner or major-stockholder cases also need the relevant temporary U.S. services and subsequent foreign-assignment evidence.
Sort general skill from company-specific knowledge
Assignments performed mainly at a third party's site carry specific restrictions concerning who supervises the worker day to day and whether the arrangement amounts to placing labour for hire. Knowledge built around a process, a system or a product line has a shelf life set by the organisation's own release and revision calendar, and a petition describing methods the group replaced two revisions ago invites an obvious question. Records may include controlled manuals, training histories, product-release material, project records, and detailed statements from knowledgeable managers. Keep US travel days out of the foreign-year total; qualifying brief visits do not themselves interrupt continuity. Processes change while someone is away, and a file claiming current advanced knowledge of a procedure introduced during the absence will not survive a question about when and how the person learned it. The review should distinguish confidential detail that may be summarized carefully from ordinary skill that any trained worker could learn quickly. Knowledge applied to the organisation's own products and procedures sits differently from the same skills sold as general consultancy to an unrelated customer, and a project that gradually reorients toward external clients can cross that line without a single decision that looks significant.
