THE SHORT ANSWER

A Beaumont couple may both work with data while only one has a U.S. job or transfer offer. Describe the second person’s actual proposed services and location before assuming the principal’s immigration plan authorizes both careers.

01

Identify each person’s category and activities

For an eligible spouse and unmarried children under 21, the dependent classification matters. TD permits study but does not authorize employment. Qualifying E and L spouses may work incident to valid status with appropriate evidence, while children do not receive that spouse authorization. Do not apply the work rule from one family category to another. Eligible TD, E and L dependents may study while maintaining their status; school enrolment does not extend that status, and immigrant CSPA rules do not extend temporary dependent eligibility.

02

Check the actual status evidence

The principal’s petition approval or job offer is not the spouse’s admission record. Verify the spouse’s classification and authorized dates, including the appropriate spouse-designated I-94 where relevant. A platform login, professional degree or Canadian client contract is not a substitute for work permission in the United States.

03

Describe remote work accurately

Identify the services, customers and location without assuming a foreign payer or unpaid arrangement settles the question. A family may coordinate its finances while still needing separate immigration assessments. Do not present one person’s right to study as permission to provide ongoing consulting services.

04

Keep future residence separate from present authority

An EB-5 petition or Gold Card payment does not itself grant residence or current work authorization. Assess the real family eligibility and any applicable age protection, rather than assuming payment universally freezes a child’s age. Family members holding immigrant visas must follow the relevant travel sequence, with the principal entering before or together with them.
