FIELD GUIDES · BEAUMONT

Seven decisions, answered before you prepare.

01

Show who selected and evaluated the statistical method

A hypothetical Beaumont statistician preparing TN evidence should connect a work sample to the applicant’s actual analytical role. A finished forecast may be useful, but it does not by itself identify the person who chose the method or assessed its limitations.

Identify methodological choices, assumption testing and interpretation. Attribute team work accurately and distinguish standard software outputs from the applicant’s decisions. Describe other assigned duties where they matter; do not assume all implementation work is excluded or that every task using numbers is professional statistics.

WHAT THIS GUIDE COVERS

  • Explain the applicant’s own contribution
  • Document the actual education
  • Complete the professional arrangement

02

Separate the TN principal’s citizenship requirement from a spouse’s TD assessment

A Beaumont household may include a Canadian citizen pursuing TN and a spouse who is a Canadian permanent resident with another citizenship. Assess each person’s proposed role instead of applying the principal’s nationality requirement as though every family member were seeking TN employment.

TN requires Canadian or Mexican citizenship; Canadian permanent residence alone does not meet that requirement. The principal also needs a listed profession, the relevant qualification, temporary entry and a permitted professional arrangement. A spouse’s Canadian citizenship cannot be borrowed to qualify the other person as a TN principal.

WHAT THIS GUIDE COVERS

  • Identify the actual principal applicant
  • Assess the dependent relationship separately
  • Keep work plans out of the dependent assumption

03

Connect software rights with the enterprise the buyer will operate

A hypothetical Beaumont buyer should read digital-service agreements before treating their price as proof of an E-2 enterprise. The records should explain the actual rights, activity and investor control, not only the technology’s advertised capability.

Describe the licence, permitted services, customer relationships and resources the buyer actually acquires or arranges. A right to use software may not include every right assumed in the business plan. Resolve the actual contractual terms and effective dates without representing a future upgrade as already available.

WHAT THIS GUIDE COVERS

  • Identify the purchased rights and operating responsibilities
  • Show a real nonmarginal commercial enterprise
  • Complete the investor conditions

04

Support a new professional team with more than future job titles

A hypothetical Beaumont manager opening a U.S. analytical operation should distinguish currently supported positions from future ambitions. A chart describing professional employees is not enough if it does not explain their actual work, resources and the applicant’s managerial duties.

For a qualifying U.S. organization doing business for less than one year, initial new-office approval is limited to one year. Show sufficient physical premises and support for a managerial or executive role within one year of petition approval. The qualifying foreign year must be managerial or executive for L-1A new-office purposes; the general established-office rule can include specialized-knowledge foreign employment. The qualifying foreign year must be full-time within the relevant three-year period. U.S. visit days do not count toward that year, although brief visits do not automatically interrupt continuity.

WHAT THIS GUIDE COVERS

  • Apply the L-1A new-office test
  • Explain the professional staffing claim
  • Preserve the corporate and employment foundation
  • Use the correct showing for a knowledge specialist

05

Compare an internal trainer’s transfer with employment by a treaty enterprise

A Beaumont employee may be considered for L-1B training work or an E-2 employee role. Begin with the real employer and assignment. A company-specific skill can be relevant to both discussions without automatically satisfying either category.

L-1B requires qualifying related organizations, continuing business, the required continuous full-time foreign-employment year within the relevant three-year period and special product or advanced process knowledge used in the U.S. assignment. A trainer title or a recent certificate does not establish the whole case. Knowledge need not be universally proprietary or unique.

WHAT THIS GUIDE COVERS

  • Identify the L-1B foundation
  • Identify the separate E-2 employee conditions
  • Do not substitute an investor budget for an employee case
  • Compare the real constraints before choosing a label

06

Plan a spouse’s independent analytical work separately from the principal’s assignment

A Beaumont couple may both work with data while only one has a U.S. job or transfer offer. Describe the second person’s actual proposed services and location before assuming the principal’s immigration plan authorizes both careers.

For an eligible spouse and unmarried children under 21, the dependent classification matters. TD permits study but does not authorize employment. Qualifying E and L spouses may work incident to valid status with appropriate evidence, while children do not receive that spouse authorization. Do not apply the work rule from one family category to another. Eligible TD, E and L dependents may study while maintaining their status; school enrolment does not extend that status, and immigrant CSPA rules do not extend temporary dependent eligibility.

WHAT THIS GUIDE COVERS

  • Identify each person’s category and activities
  • Check the actual status evidence
  • Describe remote work accurately
  • Keep future residence separate from present authority

07

Compare actual capital terms with an assumed after-tax gift price

A hypothetical Beaumont applicant may see an EB-5 offer with a repayment side letter and a Gold Card estimate reduced by expected tax savings. Both proposals require scrutiny, but the questions differ: one concerns the actual capital arrangement and the other concerns an unverified financial forecast.

Current general thresholds are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure project, with statutory adjustment beginning January 1, 2027. Lawful at-risk capital, at least ten qualifying permanent full-time jobs per investor and managerial or policy engagement remain required. The statute excludes contractual repayment rights, including investor puts even conditioned on cash flow, and capital exchanged for a guaranteed rate of return. A solely enterprise-controlled buyback has a distinct treatment constrained by sustainment and other requirements; it is not universal permission for early withdrawal. For clarity, exercising that enterprise-only option requires withdrawal of the petition unless the applicable sustainment period and other requirements have been fulfilled.

WHAT THIS GUIDE COVERS

  • Read the EB-5 arrangement as a whole
  • Use the gross Gold Card commitments
  • Retain the real immigration milestones
