Read the general immigrant investor briefing overview
A hypothetical Beaumont applicant may see an EB-5 offer with a repayment side letter and a Gold Card estimate reduced by expected tax savings. Both proposals require scrutiny, but the questions differ: one concerns the actual capital arrangement and the other concerns an unverified financial forecast.
Read the EB-5 arrangement as a whole
Current general thresholds are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure project, with statutory adjustment beginning January 1, 2027. Lawful at-risk capital, at least ten qualifying permanent full-time jobs per investor and managerial or policy engagement remain required. The statute excludes contractual repayment rights, including investor puts even conditioned on cash flow, and capital exchanged for a guaranteed rate of return. A solely enterprise-controlled buyback has a distinct treatment constrained by sustainment and other requirements; it is not universal permission for early withdrawal. For clarity, exercising that enterprise-only option requires withdrawal of the petition unless the applicable sustainment period and other requirements have been fulfilled.
Use the gross Gold Card commitments
Current official terms are US$15,000 nonrefundable processing per person and, after successful vetting, a US$1 million individual or US$2 million gift per corporate-sponsored employee. Each intended eligible joining spouse or unmarried child under 21 adds US$15,000 and US$1 million, including corporately, with initial inclusion recommended. Corporate terms include 1% annual maintenance and 5% transfer with a new background check; replacement approval is not automatic. An assumed tax benefit does not reduce the instructed gift, and this guide does not determine tax deductibility.
Retain the real immigration milestones
EB-5 petition approval does not grant residence; the applicable admission or adjustment process follows, with I-829 generally filed in the 90 days before conditional residence’s second anniversary. Gold Card uses EB-1 or EB-2 as appropriately determined, subject to eligibility, admissibility and visa availability. A private repayment date or tax-refund estimate cannot grant work permission, remove conditions or guarantee an immigration outcome.
