Read the general pathway comparison overview
A Beaumont employee may be considered for L-1B training work or an E-2 employee role. Begin with the real employer and assignment. A company-specific skill can be relevant to both discussions without automatically satisfying either category.
Identify the L-1B foundation
L-1B requires qualifying related organizations, continuing business, the required continuous full-time foreign-employment year within the relevant three-year period and special product or advanced process knowledge used in the U.S. assignment. A trainer title or a recent certificate does not establish the whole case. Knowledge need not be universally proprietary or unique.
Identify the separate E-2 employee conditions
An E-2 employee route concerns a qualifying treaty employer, the relevant same-nationality relationship and executive, supervisory or essential-skill requirements. An L-1B knowledge narrative does not automatically establish essential skills under that different assessment. Verify the actual employer’s treaty basis rather than assuming corporate affiliation alone supplies it. For an investor, development and direction can be shown by at least 50% ownership or genuine operational control through a managerial position or other corporate device.
Do not substitute an investor budget for an employee case
If the person will instead invest, E-2 investor requirements include lawful substantial at-risk capital, development and direction of a real nonmarginal enterprise and the qualifying treaty nationality. There is no universal minimum price, and intent to depart at the end of E status remains required. A purchased licence or a training invoice does not turn an employee into a qualifying investor. The nonmarginality test concerns capacity beyond a minimal living for the investor and family or a significant economic contribution. Projected capacity should generally be realized within five years of beginning normal business activity.
Compare the real constraints before choosing a label
Keep foreign-employment dates, employer ownership, duties and the applicant’s nationality accurate in each proposal. Different missing facts can lead to different next steps. The company’s course calendar does not decide eligibility, and a spouse’s ability to work depends on actual qualifying status and evidence rather than the employer’s preferred category.
