Read the general investor planning overview
A hypothetical Beaumont buyer should read digital-service agreements before treating their price as proof of an E-2 enterprise. The records should explain the actual rights, activity and investor control, not only the technology’s advertised capability.
Identify the purchased rights and operating responsibilities
Describe the licence, permitted services, customer relationships and resources the buyer actually acquires or arranges. A right to use software may not include every right assumed in the business plan. Resolve the actual contractual terms and effective dates without representing a future upgrade as already available.
Show a real nonmarginal commercial enterprise
E-2 requires more than ownership of an asset. Explain the commercial activity and the applicable capacity for more than a minimal living for the investor and family or significant economic contribution. Do not invent a universal storefront requirement for digital services or imply that a website automatically meets the operating standard. Use the real business evidence and a supported plan. Projected capacity should generally be realized within five years of beginning normal business activity. Borrowing secured only by personal assets, or unsecured personal borrowing, may qualify under the other investment conditions; debt secured by enterprise assets is excluded even when personal assets also secure it. For an investor, development and direction can be shown by at least 50% ownership or genuine operational control through a managerial position or other corporate device.
Complete the investor conditions
Confirm qualifying treaty nationality and enterprise nationality, generally at least 50% treaty-country ownership. Show lawful substantial capital committed at risk and development and direction; there is no fixed universal minimum. Review refund terms and the actual risk, including the exclusion of funds secured by enterprise assets on that basis. Intent to depart when E status ends and the appropriate permission remain necessary before U.S. work.
