BEAUMONT · L-1B FIELD GUIDE

Must the L-1 foreign-employment year always restart when the employee completes a new internal course?

THE DIRECT ANSWER

Do not assume that a course date automatically resets the calculation. Assess the actual qualifying foreign employment and the current knowledge showing as related but distinct questions.

Build the chronology from real duties and dates

Identify the period of qualifying employment, any relevant changes and the evidence of knowledge used in the proposed assignment. A recent certificate neither erases earlier qualifying work nor proves that every earlier period qualifies. The U.S. training launch date should not replace that individual assessment.

A specialized-knowledge case built around a company's own welding procedure specifications requires pulling together internal documents that were not created with an immigration filing in mind, which usually takes longer than compiling a certification list and job description. Compare the revised equipment-readiness date with the worker’s intended duties, housing commitments, foreign payroll arrangements, and remaining maximum stay; the general L-1B maximum is five years, subject to regulatory exceptions and recapture rules. When the employee will be stationed primarily at an unaffiliated worksite, the petitioner must retain principal control and supervision, and the placement must provide a petitioner-specific product or service requiring specialized knowledge rather than labour for hire.
