Does signing the EB-5 governing agreement start the I-829 calendar?

THE DIRECT ANSWER

No. Use the actual conditional-residence start, not the contract date.

Record the legal and immigration events separately

Conditional residence begins at immigrant admission or adjustment approval. I-829 is generally filed in the 90 days before its second anniversary. Keep the agreement date for the investment record without treating it as permission to reside or begin U.S. work.

EB-5 grants conditional permanent residence to an investor who places qualifying capital into a new commercial enterprise that creates at least ten full-time jobs for qualifying U.S. workers, and who takes part in managing it or in shaping its policy. Agree review points: petition filed, receipt issued, decision received, Visa Bulletin checked quarterly, visa or adjustment application lodged, and residence granted. Have any change in the project or in family circumstances reviewed as it happens, and remember that the removal-of-conditions step is still part of the plan, so initial conditional residence is not the final evidentiary milestone. The evidence obligations run on their own schedule and do not accelerate with capital: records supporting job creation must exist contemporaneously, and the petition to remove conditions is ordinarily filed in a defined window years after residence begins.
