Check a promoted employee’s foreign year before a new-office L-1A plan

THE SHORT ANSWER

The ordinary foreign-role rule and the new-office L-1A rule need to be kept distinct when a promotion occurred during the employment record.

01

Identify the actual office stage

A promotion partway through the employment history creates a specific problem, and it cannot be answered until the American entity's stage is fixed. Where the entity has been doing business in the United States for less than a year, the new-office branch applies, and doing business means the regular, systematic and continuous supply of goods or services rather than the existence of a company on a register. Incorporation, a registered office and a dormant bank account do not establish trading. Fix that point first, because it determines whether a period of specialized-knowledge work abroad can be relied on at all in a proposal for a managerial or executive American role. Settle the date the entity actually began operating, evidence it with invoices, payroll, contracts or filings, and only then map the promotion against it.

02

Apply the specific L-1A requirement

Where the new-office branch applies to a managerial or executive American role, the qualifying year abroad must itself have been managerial or executive work; a year that was specialized-knowledge work does not satisfy that particular test even though it would qualify a transfer to an established office. The petitioner also shows premises sufficient for the business and explains how the American operation will support primarily managerial or executive duties within a year of approval, and the first approval runs for a year at most. The temptation with a mid-history promotion is to move the effective date so that a clean twelve months appears; do not. Present the actual dates, the actual duties before and after, and the evidence that supports each. Hypothetical example: an engineer is promoted to head of engineering nine months before the petition is filed. Nine months of managerial work is nine months, and the honest options are to wait, to establish that the earlier duties were in substance managerial, or to consider whether the plan fits a different classification.

03

Keep ordinary and L-1B cases accurate

Keep the neighbouring rules straight so the file does not overstate what it has proved. In an ordinary transfer to an established office, qualifying employment abroad may have been managerial, executive or specialized-knowledge work, and it is the American role that has to meet the category requested. A new office seeking L-1B needs premises sufficient for the business and the financial capacity to pay the beneficiary and commence operations, with the first approval again limited to one year. Beneath both branches sit the conditions that apply to every L petition. There must be a qualifying relationship between the entities as parent, branch, subsidiary or affiliate. Both must be doing business regularly and continuously, one in the United States and the other in at least one further country. The employee must have one continuous year of full-time qualifying employment abroad within the three years preceding the petition. Time spent working inside the United States does not count toward that year, although brief visits do not automatically break its continuity, so a record of short trips should be listed with dates rather than smoothed over.
