Start with the GOLD CARD eligibility and application overview
Record the currency and the recipient
Identify each official U.S.-dollar obligation and the actual person concerned. Treat conversion estimates and banking or professional charges as separate budget assumptions. Follow current official payment instructions; an internal budget or private invoice is not an official payment confirmation.
Use the current published terms
Current official terms are US$15,000 nonrefundable processing per person, followed after successful vetting and instructions by a US$1 million individual-principal gift or US$2 million per corporate-sponsored employee. Each intended eligible joining spouse or unmarried child under 21 adds US$15,000 and a US$1 million gift, including corporately; initial inclusion is recommended. Corporate terms include 1% annual maintenance and 5% transfer with a new background check; a replacement employee is not automatically approved. The EB-1 or EB-2 result remains subject to eligibility, admissibility and visa availability.
Do not convert a budget into an outcome promise
Exchange planning does not change eligibility, admissibility or visa availability. The applicable EB-1 or EB-2 process remains necessary. A payment receipt does not itself grant residence or present work permission, and the gift should not be described as a return-bearing EB-5 enterprise investment.
Re-verify the official terms immediately before any money moves
The framework operates through existing employment-based permanent residence classifications rather than creating a new one, with successful applicants proceeding under the first or second employment-based preference. The program's terms, fees and procedures may be adjusted, and the operative version is whatever the official government source says at the moment of the decision. The review should separate an official instruction from a message that merely repeats programme news. Sequence private and public obligations carefully: review the sponsor contract, confirm the applicant’s independent immigration facts, complete verified payment instructions, and preserve the result for the filing. Read the official materials for the immigrant-category determination and keep every threshold question visible: the EB-1 or EB-2 basis, admissibility and visa availability. A deposit to a private account before any official fee is paid is not a stage the page describes, and the applicant should ask the intermediary to point to where it is. A first review should produce a funds-availability chart that distinguishes an anticipated distribution from money held by the applicant and from money that can lawfully be transferred when official payment instructions arrive. Program terms have changed since the framework was announced, so re-verify the official page and its FAQ before any money moves.
Source-of-funds review and background checks still apply
A promoter promising guaranteed approval, a fixed timeline, or immunity from background screening is describing something inconsistent with the program's official conditions, which include government vetting. Ask what official application mechanism currently exists, what immigration screening follows, and what family rules apply. Do not wire an old estimate or assume a private adviser can reallocate a government payment without authorization. Private housing or school services are not part of those gifts; additional State Department and medical charges may apply. Use only verified government channels for each instructed step and retain confirmations, identifiers and source records. The useful outcome is a list of questions with the exact document and line that prompted each one, then written clarification from the official channel where needed. A private reimbursement agreement may allocate cost, yet it cannot alter government vetting or replace identity, civil-status, or admissibility evidence. If any term is uncertain, the company should obtain clarification from the official channel before classifying, authorizing or transmitting funds.
