Does a limited policy role reduce EB-5 capital or job requirements?

THE DIRECT ANSWER

No reduction follows simply from the form of participation.

Keep the requirements separate

Current capital is US$1,050,000 or US$800,000 for a qualifying TEA or infrastructure project, with statutory adjustments beginning January 1, 2027. At least ten qualifying permanent full-time jobs per investor are required under the applicable method. Governance evidence does not substitute for either condition.

Identify the acquisition price, due-diligence and legal costs, and any working-capital needs the business will require after the purchase, separately from the qualifying investment capital itself and from government filing and immigration legal fees. Build a dated review file around the capital amount, administrative and legal charges, escrow terms, currency records, source documents, and a separate reserve budget. Government filing fees themselves follow the standard EB-5 petition and adjustment or consular processing structure under the current USCIS fee schedule, and those fees are the same regardless of which capital amount applies. A borrowing investor adds interest, arrangement fees, appraisal costs and legal fees for the security documents, and pays interest throughout a period in which the capital must remain invested and cannot be withdrawn to service it.
