Read the general pathway comparison overview
The same applicant can have different unresolved facts under L-1 and E-2; neither history should be reshaped to suit a preferred category.
For L-1, preserve the foreign-role chronology
Where one applicant has both an employment history and a funding history, each has to be tested on its own terms, and neither can be reshaped to rescue the other. The transfer route asks for a qualifying relationship between the entities as parent, branch, subsidiary or affiliate, for both to be doing business regularly and continuously in the United States and in at least one other country, and for one continuous year of full-time qualifying employment abroad within the preceding three years. In an ordinary transfer that year may have been managerial, executive or specialized-knowledge work, while the American role must meet the category requested; days worked inside the United States do not count toward the year, although short visits do not automatically break continuity. Then fix the American entity's stage, because a new office pursuing a managerial or executive role needs the foreign year to have been managerial or executive work specifically. A promotion, a secondment or a completed training programme does not substitute for the required employment period.
For E-2, preserve the financing history
The investment route is tested against the money and the ownership rather than the career. Treaty nationality is required of the investor and of the enterprise, with ownership traced to treaty-country nationals normally reaching at least half; development and direction follows from holding at least half of the business or from actual operational control. The capital must be lawful in origin, substantial against what this enterprise costs to acquire and operate, and irrevocably committed and at risk in a real enterprise that is not marginal, and no universal dollar minimum exists to measure against. Not marginal means capacity beyond a minimal living for the investor and family, or a significant economic contribution, ordinarily reachable within five years of normal trading, and intent to depart at the end of E status remains a condition. Funding drawn against security over the enterprise's own assets is excluded, and stays excluded where personal assets are pledged as well, while borrowing secured only on personal property and unsecured personal borrowing may qualify. Where security is being restructured, give the date the change took effect rather than treating a lender's stated intention as a completed release.
Compare the next real dependency
Once both records are laid out, the useful question is what each one is actually waiting on. One plan may be waiting on a period of qualifying employment that has not yet accrued, which is a matter of time and duties and cannot be argued away. The other may be waiting on a financing fact, such as a charge over enterprise assets that has not been discharged or a source of funds that is not yet documented end to end, which is a matter of instruments and dates. Those are different problems with different remedies, and confusing them produces a submission that answers neither. Identify which is binding, choose the process that fits it, and only then set an intended start for work. A promotion letter and a signed loan commitment are business documents; neither confers permission to work on the applicant, and neither settles the study or employment position of any accompanying relative, whose status has to be established on its own footing.
