Explain what the investor can do under the effective agreement instead of inventing an operating job. A label such as passive investor does not itself establish qualifying participation. Lawful at-risk capital and the required qualifying jobs remain separate conditions.
The reduced EB-5 capital amount applies to investments in a targeted employment area or a qualifying infrastructure project, and neither status follows automatically from a project being rural or geographically remote. The regional-centre programme allows indirect and induced jobs computed by economic modelling; a direct investor must count actual employees on the enterprise's payroll. Any proposed contribution of a receivable or binding future payment arrangement needs legal analysis of the actual asset, ownership, value, commitment and applicable capital rules. The rights ordinarily attached to a limited partnership interest can satisfy this, but an assurance that nothing will be required is not a description of the requirement, and the offering documents have to be read for what they actually confer.
