TD does not authorize employment. Describe the actual activity before assuming that family assistance or an unpaid label avoids the work restriction.
Separate professional work from household involvement
Identify what the spouse would do, where and for whom. A foreign payment source is not itself authorization to work while in the United States. TD can cover an eligible spouse or unmarried child under 21 and permits study, but the principal’s professional approval does not authorize a family production business. Review any separate proposed classification on its own conditions.
Choosing TD because an offer has not arrived yet is reasonable, provided everyone understands what it means in the meantime: study is permitted, employment is not, and there is no blanket rule allowing work while a later application is pending. Build a separate identity and relationship packet for each family member: passports, marriage record, birth records for children, and genuine name-change documents. Some households manage the risk by having the Canadian business run day to day by an on-site manager, with the spouse holding only an ownership interest and taking distributions rather than a salary for services performed while present.
