Start with the L-1A eligibility and application overview
Describe the executive responsibilities explicitly
The executive definition concerns primarily directing management of the organization or a major component or function, establishing goals and policies, exercising wide discretionary latitude and receiving only general supervision or direction from higher executives, the board or owners. Use actual decision records and responsibilities, not an assumption that every board report either proves or defeats the role.
Explain reserved decisions and ordinary operations
Identify what the board approves, what the applicant decides and who manages daily delivery. Different approval arrangements can have different implications. Describe limits honestly rather than omitting oversight from the file. A signature authority or budget size alone does not establish the complete executive function.
Retain the qualifying transfer conditions
The organizations must have a qualifying relationship and meet the doing-business requirements. Assess the required continuous full-time qualifying year abroad within the relevant three-year period. New-office L-1A cases additionally require sufficient premises and an operation supporting managerial or executive work within one year of petition approval, with an initial approval maximum of one year. The board structure does not replace those conditions. The ordinary qualifying foreign year may be managerial, executive or specialized-knowledge employment; the U.S. role must meet the requested classification. The group must continue regular, systematic business in the United States and at least one other country. For new-office L-1A, the foreign year must specifically be managerial or executive. The new-office trigger is less than one year of qualifying U.S. business activity. An owner or major stockholder must also show temporary U.S. services and a subsequent foreign assignment.
Decide between people management and function management
A share register, subscription agreements, a capitalisation table and board minutes are what establish that the Canadian and U.S. entities stand in a parent, branch, subsidiary or affiliate relationship. Managing an essential function can qualify where the factual showing supports it, so describe the function, the applicant's seniority within the organisation, and who performs the day-to-day tasks the applicant does not. Organization charts should identify subordinate supervisors or professionals, while job descriptions, calendars and examples of decisions should show how the applicant allocates resources and directs functions. A useful first review ends with a proposed organization chart for the first six months, naming who performs the operational work and who reports to the transferee. Personnel management rests on supervising and controlling professional or supervisory staff; function management rests on managing an essential function at a senior level without necessarily supervising anyone. A manager may supervise people or manage an essential function, but the record should show who does the underlying work and what decisions the transferee actually controls. U.S. days do not count toward the foreign year, although brief visits do not automatically interrupt continuity. Before deciding to file, map every claimed supervisory responsibility to a dated delegation, organization chart, and the name of the person who carried out the underlying task.
