Explain the executive function accurately
Identify direction of management, policy-setting, wide discretionary authority and the level of supervision. The executive definition permits general direction from a board or higher authority; it does not require complete freedom from oversight. Show who will perform operational work instead of treating every task done by a titled executive as executive activity. The qualifying foreign year must be full-time within the relevant three-year period. U.S. visit days do not count toward that year, although brief visits do not automatically interrupt continuity.
Support the new-office conditions
The new-office framework concerns the qualifying organization doing business in the United States for less than one year. Secure sufficient physical premises and show that the operation will support managerial or executive duties within one year of petition approval. Initial new-office approval cannot exceed one year. Use realistic staffing, contracts and resources rather than an unsupported first-year chart.
Retain the foreign employment and business foundation
For an L-1A new office, the required qualifying continuous full-time year abroad within the relevant three-year period must involve managerial or executive work. Document the qualifying relationship and continuing business requirements. A board resolution does not replace employment history or evidence of actual operations, and commercial delays do not automatically extend authorized stay.
