Start with the GOLD CARD eligibility and application overview
Identify the recipient and legal purpose of each payment
The official Gold Card framework describes a processing fee, vetting and a gift to the U.S. government after successful vetting. That gift is not EB-5 capital invested in a commercial enterprise for return. A separate private investment or service contract must be identified as separate; its promotional language does not change the government payment’s purpose.
Use the current official amounts
As checked September 7, 2026, the nonrefundable processing fee is US$15,000 per person. The principal gift after successful vetting is US$1 million individually or US$2 million per corporate-sponsored employee. Each eligible joining spouse or unmarried child under 21 adds US$15,000 and US$1 million, including corporately. Corporate terms include 1% annual maintenance and 5% transfer with a new background check. Additional visa-related and medical charges may apply. A corporate transfer does not automatically approve the replacement employee.
Separate immigration eligibility from commercial promises
Successful cases use EB-1 or EB-2 subject to category eligibility, admissibility and visa availability. A promise of repayment, yield or guaranteed approval from a private party is not the government’s determination. Follow current official instructions and preserve the actual terms before deciding what a proposed payment would accomplish.
Verify the payee and instruction stage before transferring funds
If an applicant researches the programme, retain the date-stamped official page, FAQ, correspondence from an authorized government channel, payment confirmation if one is made, and records showing the lawful origin of any funds. The official material states that permanent residence flows through existing employment-based categories as determined by the administering authorities, subject to visa availability. Sending the instructed amount correctly, with the correct reference, through a channel the receiving process accepts, resolves a payment question and nothing more. Under the official framework and Executive Order 14351, the qualifying gift is treated as evidence relevant to the specified EB-1 or EB-2 basis; the applicant must still be eligible for lawful permanent residence, admissible and have a visa available. Gold Card is therefore a programme framework using existing immigrant classifications, not a standalone conventional visa classification or an EB-5 investment. A first review should make a dated comparison table: the official instruction, the applicant named in it, the payee, each amount, and the eligibility stage that comes before payment. Confirm the official request, payee, portal instructions, and applicant identity, and re-verify every term before funds move. No private adviser, broker, or business opportunity can convert a payment discussion into a conventional visa application.
What the program is, in the government's own terms
Government notices can contain errors: if a notice conflicts with the instructions or with your record, investigate the conflict with counsel rather than acting on something you can see is wrong. Do not infer that an announced program bypasses inadmissibility or other federal screening questions. Whether a closely held company can sponsor its own principal, and how the tax treatment of such a payment would work in either country, are questions for the official program terms and for the company's own tax advisers respectively. Payment of the nonrefundable fee, and later the gift when instructed, does not purchase citizenship, waive a ground of inadmissibility, or create availability where none exists. Two points belong in the file because conversation commonly reverses them: the payment runs from the applicant to the U.S. government, and it follows vetting and official instructions rather than preceding them. A payment instruction does not resolve whether the principal meets EB-1 or EB-2 requirements, and an otherwise strong merits file does not excuse incomplete identity or admissibility information. An adviser’s statement that a file was closed may describe the adviser’s engagement rather than an agency action; resolve that difference before repeating it as an official result.
