Reassess the assignment and the knowledge it requires. Do not keep a filing description based on work the employer no longer intends the applicant to perform.
Update the role at the point the plan changes
Identify the replacement duties and the applicant’s actual experience with them. Separate knowledge already held from planned learning. Preserve the earlier project account and explain material revisions for the appropriate procedural review. A transfer invitation does not itself authorize a different role after the original operational need disappears.
Evidence must still establish a qualifying corporate relationship, one continuous eligible foreign year in the previous three, and specialized company knowledge required by the American assignment. Preserve the corporate link, one continuous full-time year abroad in a managerial, executive, or specialized-knowledge capacity within the relevant preceding three-year period, and, outside the special U.S. new-office rules, both-country operations. If the employee will be stationed primarily at an unaffiliated worksite, that unaffiliated employer cannot principally control and supervise the employee, and the placement cannot be essentially an arrangement to provide labour for hire rather than to use the petitioner’s specialized knowledge.
