Should the spouse’s L work plan use the projected system-retirement date as its authorization end date?

THE DIRECT ANSWER

No. The spouse’s actual valid status and evidence govern authorization, not the employer’s technology calendar.

Keep the household dates tied to immigration records

A qualifying L spouse may work incident to valid dependent status, while children do not receive that spouse permission. Record current classification and validity and assess any proposed extension through the actual process. A project that runs late does not automatically extend the family’s stay, and an early retirement does not justify assuming the same consequence for every individual without review. Dependent eligibility concerns an eligible spouse and unmarried children under 21; assess the individual status and authorized period.

Where a family previously moved together, the questions worth re-asking are narrow: has any child married or turned 21, does any family member now hold a different status, and has any document been superseded by later travel. A school enrolment, a resignation letter and a lease each convert a plan into an obligation, and every one of them depends on a status that is not settled until the specialized-knowledge account and the qualifying year abroad have both been assessed.
