Can knowledge of a system scheduled for retirement support an L-1B case?

THE DIRECT ANSWER

Assess the actual knowledge and proposed work. Planned retirement does not automatically remove relevance, but the employer must explain why the assignment uses qualifying organizational knowledge.

Describe the remaining operational need

Identify what must be maintained, migrated or resolved and the applicant’s real capability. The standard concerns special or advanced organizational knowledge, not merely familiarity with old equipment. There is no universal requirement of uniqueness, but long service and a retirement deadline do not themselves prove the standard or the separate qualifying transfer conditions.

Prove an uninterrupted qualifying foreign-employment year from the applicable three-year lookback, the required parent, branch, subsidiary, or affiliate link, and ongoing business abroad plus either U.S. business or compliance with the initial new-office requirements. L-1B rests on one continuous year of qualifying employment with a related entity abroad within the preceding three years, and on specialized knowledge of the organisation's product or its procedures; the length or prominence of the project establishes neither. No set training duration qualifies anyone, and completing a programme is not itself the showing; what matters is knowledge of the organisation's own products, services, or advanced processes, evidenced by the facts of work performed.
