What if the board changes the executive’s authority during L-1A preparation?

THE DIRECT ANSWER

Update the role account and assess the material change. Do not rely on powers that have been removed or describe new authority as already effective before it is.

Preserve the governance history

Identify the decision date, actual effective terms and remaining responsibilities. Keep the earlier description available and explain the revision. The appropriate filing or update depends on the actual status and proposed work; an internal resolution does not automatically change immigration authorization. Coordinate the business role with the process required for the current facts.

For someone initially admitted in specialized-knowledge capacity, the regulation requires at least six months in the managerial or executive position to qualify for the seven-year total, and approval of the change in an amended, new or extended petition when it occurs. Compare the employee’s present foreign duties with the proposed U.S. role, recalculate whether one continuous qualifying year abroad falls within the three years before filing, and revise letters, charts, budgets, and the staffing plan to remove unearned authority. A new-office approval runs one year, so evidence for the extension, meaning actual staff, actual revenue and a role that remains primarily managerial or executive as described, accumulates from the first month rather than the eleventh.
