Does a large board-approved operating budget establish L-1A executive capacity?

THE DIRECT ANSWER

The budget may show business scale, but the applicant’s actual policy responsibilities, discretion and direction of management remain the issue.

Connect financial evidence with authority

Explain who proposes, approves and controls expenditure rather than attributing every corporate dollar to the executive. Keep business costs separate from official immigration charges and professional-service scope, verifying current fees. Paying for an elaborate chart or financial presentation does not cure a role that lacks the required substance.

The Form I-129 filing fee, the fraud-prevention fee, any asylum program fee applicable to the employer’s size, and optional premium processing, all at the amounts on the USCIS fee schedule, plus the cost of preparing the corporate and employment evidence. The expense easiest to overlook is the one the petition itself depends on: an executive role only exists if other people are doing the operational work, and hiring those people costs wages before the U.S. operation produces revenue. A recently completed acquisition needs its corporate story assembled by somebody who understands what an adjudicator is testing: purchase documents, share registers, registry extracts and proof that the American terminal is doing business.
