Reassess the actual role when implementation diverges materially from the proposed managerial duties.
Use operations to test the staffing assumptions
Track what the applicant actually performs and why the model changed. For a new-office L-1A case, the operation must support the managerial or executive role within one year of approval. An old plan does not establish the role after its execution assumptions fail.
Keep the original submitted plan and record actual staffing, financial and operational developments as they occur, since the extension filing relies on what genuinely happened rather than a restated forecast. Revise the petition record when a delayed opening changes headcount, revenue assumptions, reporting lines, or the share of time spent on qualifying duties. Describe realistically what staffing and financing will exist at the outset, and keep the actual operating record for the extension stage rather than treating the initial business plan as if it were already accomplished. For a new office, the initial period lasts one year, the filing must show sufficient premises and financial ability to remunerate the beneficiary and commence doing business, and the business must develop enough to sustain qualifying management; the L-1A limit is seven years.
