What should a vendor-supported L-1A organization chart show?

THE DIRECT ANSWER

Show the actual relationships and distinguish employees, outside providers and decision authority.

Avoid a misleading reporting diagram

Use contracts and responsibility descriptions to explain how work is performed. Do not portray every vendor’s staff as the applicant’s employees. The evidence should make the managerial claim understandable while preserving the real legal and operational relationships.

Documents that show delegated power rather than describe it: board resolutions, signing and spending authority limits, organizational charts for both entities, minutes recording decisions the individual made, and the employment agreement's description of reporting lines. Separate the foreign job into dated phases and prove each with contemporaneous material: employment agreements, payroll, performance reviews, organization charts, budgets, approvals, calendars, and records showing who performed daily operations. The activity stack contains signed customer contracts, issued and settled invoices, payroll registers, equipment leases, operating authority and insurance certificates, and filed tax returns showing revenue. Two records usually carry this analysis: an organizational chart showing who reports to the applicant and who those people direct in turn, and a written delegation of authority such as a board resolution, a signing-authority schedule or a spending limit recorded in policy.
