A specialist connected with Parkland County is scheduled at several unaffiliated U.S. customers. Evaluate the actual knowledge and each placement arrangement rather than treating an employer logo on the assignment letter as sufficient control evidence.

Start with the L-1B eligibility and application overview

01

Explain the product or service behind each placement

Identify the petitioner’s specialized-knowledge product or service and the applicant’s actual work. Compare who directs the tasks, evaluates performance and controls the assignment at each customer. Do not assume identical contracts mean identical working arrangements. For each customer location, record the deliverable, the petitioner’s relevant product or service and the person who gives substantive work instructions. Explain how changes to scope are approved and who evaluates performance in practice. Compare those facts with the contract rather than assuming a standard clause describes every placement. If one customer uses the applicant to fill an ordinary staffing vacancy, identify that difference instead of merging it with a different site’s product implementation. The review should show the actual placement being proposed at each location. A company-wide payroll record can remain part of the evidence, but it should not be asked to answer the distinct questions about customer direction and the nature of the work.

02

Apply both offsite restrictions

At a principally unaffiliated worksite, L-1B is barred if that employer principally controls and supervises the employee, or the placement is essentially labour for hire rather than tied to the petitioner’s specialized-knowledge product or service. A petitioner’s continuing payroll does not by itself answer either restriction. Document the substance of the customer placement.

03

Establish the knowledge and qualifying transfer

L-1B covers special knowledge of the organization’s products, services, research, equipment, techniques, management or other interests and their international application, or advanced knowledge of its processes and procedures. Knowledge need not be unique or proprietary. A U.S. organization doing business for less than one year needs sufficient premises and financial ability to pay the beneficiary and commence business; initial new-office approval is at most one year. Owners or major stockholders also need temporary-services and subsequent foreign-assignment evidence. Establish a qualifying parent, subsidiary, affiliate or branch relationship, continuing regular business in the United States and at least one other country, and one continuous full-time qualifying foreign year within the relevant preceding three years. Ordinary foreign work may be managerial, executive or specialized knowledge; the U.S. role must meet the requested classification. U.S. visit days do not count toward the foreign year, although brief visits do not automatically break continuity.

04

Sort general skill from company-specific knowledge

Take the acquisition first: how long the employee worked with the system, process or product, what training the organisation gave, and which internal documentation only that group holds. If part of the assignment will occur at a municipal client's plant, the petition must show the transferee remains directed and controlled by the petitioner, performing work involving its specialised knowledge, rather than being supplied as labour to the client. A controlled workflow, revision history, and documented exceptions may substantiate process knowledge; product-release records and cross-border implementation material may substantiate knowledge of the offering. General kiln-operation skill does not qualify merely because it is deep; the legal distinction is the special or advanced character of the knowledge, not whether it originated exclusively inside the company. Ask which records would allow a new reviewer to distinguish the knowledge from general industry skill: training histories, role progression, technical correspondence, controlled procedures or concrete examples may help. Vague statements that the worker is valuable tend to fail because they never identify what the worker knows or how that knowledge was learned. The documents should connect a particular internal product, procedure or application to the assignment, while accurately distinguishing company-specific knowledge from skills broadly available in the industry.
