Read the general immigrant investor briefing overview
Who can access an account and who pays an expense are starting facts, not complete immigration classifications.
Identify ownership, payment authority and the named principal
Make a short record for each proposed transaction: whose money it is, who may initiate the transfer, who is the immigration applicant and where the money goes. Joint signing authority is not proof that the EB-5 applicant owns the entire account balance. Similarly, an employer paying an expense does not by itself identify the individual or corporate Gold Card route. Resolve these facts before comparing totals; otherwise the calculation may describe a different person’s resources or a different application.
Audit the joint-account investment documents
Trace material contributors and lawful sources. If ownership passes through a gift or loan, record the real terms and the required good-faith, noncircumvention arrangement. EB-5 currently requires US$1,050,000, or US$800,000 for a qualifying TEA or infrastructure project, with statutory adjustments beginning January 1, 2027. The investor needs qualifying at-risk capital and managerial or policy-formulation participation. Do not assume that an account holder contributing money becomes an eligible derivative: the family assessment is separate from the source account.
Test what the enterprise promises to do and repay
Establish at least ten qualifying permanent full-time jobs per investor using the applicable direct or regional-center method. Direct positions need at least 35 weekly hours and qualifying employees; contractors, nonimmigrants, the investor, spouse, sons and daughters are excluded. Examine the agreement for a contractual repayment right or guaranteed return, which is excluded capital. An enterprise-only discretionary option has a narrow exception, but exercise requires petition withdrawal unless sustainment and the other statutory requirements are fulfilled. Keep these rights beside the source account rather than assuming a bank transfer establishes the entire case.
Reconcile the employer’s offer with official Gold Card obligations
Ask which costs the private offer actually covers; do not call it an official receipt. Current government terms are US$15,000 nonrefundable processing for each person, then after successful vetting and instructions a US$1 million individual-principal gift or US$2 million per corporate-sponsored employee. For every intended eligible joining spouse or unmarried child under 21, add a US$1 million gift and processing; initial inclusion is recommended. Corporate terms also specify 1% annual maintenance and 5% transfer plus a new background check, without automatic approval of a replacement. The applicable EB-1 or EB-2 result still depends on eligibility, admissibility and visa availability. Gold Card is not EB-5 conditional residence: EB-5 starts at immigrant admission or adjustment approval, followed generally by I-829 in the 90 days before the second anniversary. Neither reimbursement, payment nor petition approval alone establishes current residence or work permission.
