No. The applicant’s actual duties and authority must establish the requested managerial or executive role.
Explain the operating division of work
Identify who performs routine work and what decisions the applicant manages. Outsourcing may be relevant evidence, but a vendor list alone cannot show that most duties are managerial. Keep contractor relationships distinct from employee reporting lines.
If the U.S. organization has been doing business for less than one year, assess L-1A new-office requirements, including sufficient premises, required foreign managerial or executive employment and ability to support the intended managerial or executive role within one year of approval. Where the corporate structure involves several owners or holding entities, ask counsel to assess control using the actual governing documents rather than a simplified organizational chart. Managerial capacity means managing the organization or a department, supervising and controlling the work of other supervisory, professional or managerial employees, or managing an essential function, with authority over hiring and firing or the equivalent, and exercising discretion over day-to-day operations. The classification also requires one continuous year of qualifying employment with the organisation abroad within the three years preceding the filing, in a managerial, executive, or specialized-knowledge capacity, so a founder who ran the company informally still needs that period evidenced.
