Separate payer, sponsor and applicant
Record who applies, which route is intended and who supplies each payment. Retain the actual official instructions and receipts without describing a reimbursement promise as a completed government payment. Clarify the arrangement before applying an individual or corporate price to it.
Use the published terms for the relevant route
Current official terms are US$15,000 nonrefundable processing per person, followed after successful vetting and instructions by a US$1 million individual-principal gift or US$2 million per corporate-sponsored employee. Each intended eligible joining spouse or unmarried child under 21 adds US$15,000 and a US$1 million gift, including corporately; initial inclusion is recommended. Corporate terms include 1% annual maintenance and 5% transfer with a new background check; a replacement employee is not automatically approved. The EB-1 or EB-2 result remains subject to eligibility, admissibility and visa availability.
Keep corporate reimbursement separate from immigration permission
An employer’s agreement to cover costs does not establish approval, admissibility or work authorization. Review the applicable EB-1 or EB-2 process and the actual person’s eligibility. Do not describe a government gift as an EB-5 investment or promise a financial return.
Compare the consequences with other permanent-residence routes
The applicant must still be eligible for permanent residence under an EB-1 or EB-2 classification as determined by the authorities, admissible under the ordinary grounds, and able to obtain a visa number under the Visa Bulletin. A program label does not tell a household whether it has a filing mechanism, an approved payment channel, a derivative-family rule, or an immediate immigration consequence. Compare the legal evidence required, family treatment, financial exposure, and tax consequences of each route independently, and recheck the current official instructions before acting, since a government FAQ is a dated reference rather than a permanent guarantee that every term stays unchanged. The Gold Card is an administrative program using existing employment-based immigrant classifications; it does not establish a standalone conventional visa classification. Match the payer, recipient, amount, and stated purpose to the operative official material. The applicant should not treat a broker’s request, a company reimbursement or a private escrow as an official instruction. What goes wrong is assuming that a payment, corporate support, or a charitable history replaces admissibility, visa availability, screening, or the underlying immigrant-category requirements. Confirm the official instruction, payer and amount before sending money, separately from an adviser’s service charge.
Re-verify the official terms immediately before any money moves
Paying the nonrefundable fee and, later, making the gift when instructed does not purchase citizenship, waive inadmissibility, or create availability where none exists. Re-verify the current official terms directly before transferring anything: the amounts, the payee, the sequence of vetting and payment, and what happens on refusal. Whether becoming a permanent resident changes taxation of worldwide income belongs to a qualified tax adviser. Anyone comparing this framework against an investment route should hold that distinction throughout, because the vocabulary of investment is used loosely in discussion of the programme and it changes how the risk appears. Organize identity and source-of-funds records so they can be compared with whatever official screening process is announced, but do not assume a document list from another immigration category will apply. Because the framework is new and administered through executive action, the terms should be re-verified on the official page immediately before any payment. If the details connecting the two were entered by a third person, whether an assistant, a relative or a consultant, that person is the first one to speak to, because nothing else moves until the channel is right. A third party’s estimate or a promotional summary cannot substitute for the programme’s actual payment direction.
