Can an employer’s payment deadline determine when Gold Card work authorization begins?

THE DIRECT ANSWER

No. A commercial deadline is separate from the actual immigration permission.

Coordinate without inventing approval

Identify what the employer expects to happen and what official milestones remain. The EB-1 or EB-2 result remains subject to eligibility, admissibility and visa availability. Do not promise a U.S. start date solely because payroll has approved reimbursement.

The official Gold Card page currently says the process should take weeks, but that estimate is not a guaranteed completion date, and an employer's enthusiasm does not shorten government vetting or create a visa number. Identify what would need to change in the household's plans if additional information or a further step is required, and avoid finalizing housing, employment or school arrangements around an assumed approval date. The current FAQ says the process should take weeks if documents and the visa interview are completed promptly, but that statement is not a guaranteed deadline and visa availability can still cause waiting. The official channel answers enquiries about a specific application; a payment processor answers questions about a transaction; counsel advises on what follow-up options exist if an unexplained delay continues. Nobody legitimate needs a payment sent to a private account, an agent or a facilitation service in order to secure a place, and pressure to act before a deadline nobody can point to is a reason to stop rather than hurry.
