Can a future reorganization establish managerial duties from the first day?

THE DIRECT ANSWER

Describe the actual initial role and any applicable new-office development plan. An expected later promotion does not automatically establish the required present case.

Place the authority changes on a dated plan

Explain when reporting rights and responsibilities take effect and who performs operating work meanwhile. New-office L-1A has its specific within-one-year support requirement; an ordinary case should not simply borrow that development period. A proposed internal reorganization also does not extend the applicant’s approved stay.

Confirm early whether the receiving U.S. entity has sufficient operating history and staffing to be treated as established, since that affects both the evidence needed and the length of initial approval available. A newly established base abroad adds a parallel track of premises and funding evidence, and its initial approval period is short enough that the first year's plan must be genuinely achievable rather than optimistic. L-1A eligibility also rests on a continuous qualifying foreign year within the previous three and a qualifying parent, branch, subsidiary, or affiliate relationship, with the foreign organization doing business; for a new-office L-1A petition, that foreign year itself must have been managerial or executive.
