THE SHORT ANSWER

A hypothetical Leduc County couple may have an engineering assignment for one spouse and a franchise-management opportunity for the other. Map each proposed activity to the person who will perform it and the actual status relied upon.

01

Distinguish accompanying from working

An eligible spouse and unmarried children under 21 may seek the relevant dependent classification. TD allows study but does not authorize employment. A spouse accompanying a TN engineer cannot assume permission to run the franchise, even if the business belongs to a relative or pays from Canada. Eligible TD, E and L dependents may study while maintaining their status; school enrolment does not extend that status, and immigrant CSPA rules do not extend temporary dependent eligibility.

02

Use the E or L spouse rule only when it actually applies

Qualifying E and L spouses may work incident to valid status with appropriate evidence. Confirm the spouse’s classification, dates and relevant spouse-designated I-94 record instead of relying on the principal’s employer letter. Dependent children do not receive that spouse work authorization.

03

Keep separate principal proposals accurate

If both spouses pursue principal classifications, each needs the relevant eligibility and permission. One person’s TN profession does not establish the other’s E-2 investment, and the franchise purchase does not extend the engineer’s permitted duties. Describe the genuine division of work rather than moving responsibilities between people only on paper.

04

Avoid using an immigrant plan to bridge a work gap

An EB-5 petition or Gold Card payment does not itself confer current U.S. residence or work authorization. Review each family member’s actual eligibility, including any applicable child-age rules. For immigrant-visa travel, follow the real validity and entry instructions, including the principal entering before or with derivative family members.
