THE SHORT ANSWER

A hypothetical Leduc County manager may open a U.S. operation reporting both locally and globally. Describe the actual organization, resources and duties instead of assuming the two reporting lines establish a managerial role.

01

Determine whether the office meets the definition

Identify the qualifying U.S. organization and whether it has been doing business for less than one year. A recently signed lease or new team name is not decisive by itself. Establish the qualifying corporate relationship and continuing U.S. and foreign business foundation alongside the actual operating history. The qualifying foreign year must be full-time within the relevant three-year period. U.S. visit days do not count toward that year, although brief visits do not automatically interrupt continuity.

02

Build the L-1A showing around responsibilities

For a new-office managerial transfer, the qualifying foreign year must be managerial or executive. Show sufficient premises and evidence that the U.S. operation will support the managerial or executive position within one year of approval. Explain who performs operating work, how the applicant manages the essential function or organization and how conflicting instructions are resolved. There is no universal required headcount.

03

Keep L-1B and ordinary L-1A rules distinct

A specialist new office needs sufficient premises and financial ability to compensate the beneficiary and commence business, with qualifying special or advanced organizational knowledge. Ordinary L-1A foreign employment may be managerial, executive or specialized knowledge; do not impose the new-office managerial-year rule on every case. The required continuous year within the relevant three years and other transfer conditions remain necessary.

04

Use the actual authorized period

Initial new-office approval is limited to one year. A future staffing milestone does not automatically extend that period or cure an unsupported role. Owner or major-stockholder cases also require the appropriate temporary U.S. services and subsequent foreign-assignment evidence. Budgeting for an office and receiving permission to work there are different events.
