Start with the L-1B eligibility and application overview
Explain the knowledge behind the records
L-1B concerns special knowledge of the organization’s products, services or other interests and their application in international markets, or advanced knowledge of its processes and procedures. Show how the applicant interprets the history, diagnoses exceptions or applies an organizational method. Access permission, a long archive or a high job grade does not alone establish the required knowledge.
Connect prior experience with the proposed work
Describe the relevant foreign assignments and the knowledge to be used in the United States. Documents may support the account without needing to disclose every confidential detail publicly. Knowledge is not universally required to be unique or proprietary, but a statement that every experienced employee knows the process does not explain this applicant’s qualifying case. If primarily stationed at an unaffiliated worksite, the employee cannot be principally controlled and supervised by that employer, nor placed essentially as labour for hire rather than in connection with the petitioner’s specialized-knowledge product or service.
Retain the corporate and duration requirements
Establish qualifying parent, subsidiary, affiliate or branch organizations, continuing business in the United States and abroad, and the required continuous full-time foreign-employment year in the relevant three years. New-office cases need sufficient premises and financial ability to compensate the beneficiary and commence business, with initial approval no longer than one year. Ordinary individual initial approval may be up to three years; the general L-1B limit is five years subject to applicable counting rules. Owner or major-stockholder cases need the appropriate temporary-services and subsequent foreign-assignment evidence. That foreign year must be full-time qualifying managerial, executive or specialized-knowledge employment; the U.S. role must use specialized knowledge. The new-office trigger is less than one year of doing business by the qualifying U.S. organization.
Review the actual placement and supervision
Where the assignment would place the employee at a client site, say so, because offsite placement carries specific supervision and labour-for-hire restrictions that need a proper legal assessment. Knowledge of a company's own validated processes, its quality management system, its customer-specific qualification protocols and its documented rationale can be special to the organisation even though the underlying standards are public. Training records, project histories, internal manuals, and knowledgeable supervisor statements may be useful when they accurately identify the employee's contribution. A first review should produce a knowledge map: the product feature or procedure, the internal records showing the worker learned it, the colleagues who can confirm it, and the U.S. task that calls for it. Record U.S. days separately from qualifying foreign service without assuming brief visits automatically interrupt continuity. The actual special or advanced knowledge standard must be supported without imposing a universal uniqueness or secrecy requirement. Controlled manuals, training paths, process records, problem-resolution logs, and customer implementation evidence often answer those questions better than adjectives in a manager letter. Where the honest answer is broad familiarity built by time rather than advanced knowledge of the organization's own methods, say so early, while other routes can still be discussed.
