Can the spouse accept a different employer’s offer during the transfer?

THE DIRECT ANSWER

A qualifying L spouse may work incident to valid L status with appropriate evidence. The principal’s transfer letter or petition approval is not itself the spouse’s status record.

Check the spouse’s start independently

The spouse should confirm the actual classification, dates and applicable spouse-designated I-94 evidence before relying on work authorization. The offered job need not become part of the principal’s management chart to create a convincing transfer narrative. Unmarried children under 21 may qualify as dependents but do not receive the spouse’s work authorization.

None of this alters the principal’s own case, which still turns on a qualifying relationship between the entities, one continuous year of qualifying employment abroad within the preceding three years, duties that are primarily managerial or executive, and the seven-year ceiling on L-1A time. Before the household commits to anything that presumes continuity — a lease, a school year, an employment contract for the spouse — confirm which document each person would rely on to prove their permission on the day it is questioned, and when that document expires. Age is the condition to watch: dependent status is available only while a child is under twenty-one and unmarried, so a household with a nineteen-year-old should plan for a change to student status well before the birthday rather than in the month it arrives.
