A commercial extension is not the spouse’s status extension. Review the spouse’s current individual record and the applicable immigration step.
Keep family dates separate from the client agreement
TD is available under its conditions to an eligible spouse or unmarried child under 21, permits study and does not authorize employment. The principal’s new engagement does not automatically change those permissions. Record each person’s current authorized period and any pending process, without assuming the client’s extended end date allows additional stay or work.
A spouse admitted as a dependant of a treaty professional may accompany, live and study, including a full degree programme, but may not take a job, and that includes remote work performed from the United States for a Canadian employer. Consider whether the spouse might work remotely for a Canadian employer in the interim, and confirm separately whether that arrangement is workable while in the US on TD status, since remote work still raises its own questions. TD carries no work authorization at any point, so a partner who intends to keep earning needs an independent status that permits it, and the relationship must be a legally recognized marriage because a common-law partner has no derivative eligibility at all.
