FOR BUSINESS LEADERS · ST. ALBERTSt. Albert

Built in Canada.Ready for more.

A hypothetical St. Albert employee previously assigned for specialized-knowledge work is now offered responsibility for a U.S. department. A promotion announcement does not by itself establish managerial or executive capacity or update the immigration arrangement. Explain the actual new role and the timing of its duties.

Start with the L-1A eligibility and application overview

01

Show the work that changes after promotion

Identify decisions, personnel or function responsibility and the ordinary tasks that other people will perform. Distinguish an actual managerial or executive role from a senior technical position with a new title. If the applicant continues substantial delivery work, describe it accurately rather than treating every post-promotion hour as management.

02

Review the transfer history and current process

A qualifying organization relationship, doing-business evidence and the required continuous full-time qualifying year abroad within the relevant three-year period remain part of the assessment. The appropriate procedure for a current employee’s changed role depends on the actual status, history and timing. Do not assume a promotion automatically changes classification or creates a fresh period of stay. The ordinary qualifying foreign year may be managerial, executive or specialized-knowledge employment; the U.S. role must meet the requested classification. The group must continue regular, systematic business in the United States and at least one other country. For new-office L-1A, the foreign year must specifically be managerial or executive. The new-office trigger is less than one year of qualifying U.S. business activity. An owner or major stockholder must also show temporary U.S. services and a subsequent foreign assignment.

03

Keep new-office requirements distinct

Where the new-office framework applies, sufficient physical premises and an operation able to support managerial or executive duties within one year of petition approval are required for L-1A; initial new-office approval is limited to one year. A promotion inside an established office is not automatically a new-office case. Identify the real operating history before applying that framework.

04

Apply the specific promotion and maximum-stay rule

The regulation generally limits specialized-knowledge stays to five years and managerial or executive stays to seven years. For a person initially admitted in specialized-knowledge capacity and later promoted, eligibility for the seven-year total requires at least six months employed in the managerial or executive position, with the change approved in an amended, new or extended petition when it occurs. A promotion does not erase earlier counted time. Review the actual history and any applicable exception before calculating the remaining period.

05

Explain authority in the proposed organization

Explain whether the proposed work manages the function or primarily performs purchasing transactions. A manager supervises and controls the work of other supervisory, professional or managerial employees, or manages an essential function of the organisation at a senior level, with authority over day-to-day operations. Share registers, articles of incorporation, purchase agreements and, where the structure is layered, a chart naming every intermediate holding company are what establish parent, subsidiary or affiliate status. An executive directs management, sets goals and policies, exercises wide latitude in discretionary decision-making, and answers only to general supervision from owners or a board. Provide an organization chart of the U.S. company from payroll, showing branch managers, an agronomist and an office manager reporting to the general manager. Look at the subsidiary's staff list: if there are installers and a service coordinator to supervise, and the transferee will plan work, hire, set pricing and manage the customer relationships, the role is managerial.
