Start with the EB-5 eligibility and application overview
Identify what changed in the project evidence
Separate a construction or operating delay from changes in capital use, job methodology or the investor’s rights. Obtain the actual update and identify who can substantiate it. A project representative’s reassurance is not the same as evidence that the applicable immigration requirements have been met. For gifted or borrowed capital, establish lawful source and a good-faith arrangement that does not circumvent restrictions on permissible capital sources. Capital exchanged for a contractual repayment right or a guaranteed rate of return is excluded. An option exercisable solely at the new commercial enterprise’s discretion has a narrow exception: exercising it requires petition withdrawal unless the applicable sustainment period and other requirements have been fulfilled. For direct employment, a qualifying permanent full-time position requires at least 35 hours weekly; independent contractors, nonimmigrants and the investor, spouse, sons or daughters are excluded from qualifying employees.
Retain the capital, jobs and participation conditions
Current general thresholds are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure project, with statutory adjustment beginning January 1, 2027. Qualifying capital must be lawful and at risk, with at least ten qualifying permanent full-time jobs per investor under the applicable rules and the required management or policy-formulation participation. Direct and regional-center job evidence follows different methods. Review the investor’s actual filing and applicable rules rather than assuming a new threshold automatically applies to every existing case.
Follow the actual residence and later filing stage
Investor-petition approval is not residence. The applicable immigrant-visa or adjustment process follows subject to eligibility and visa availability. EB-5 residence is initially conditional; I-829 is generally filed in the 90 days before its second anniversary to seek removal of conditions. A commercial project delay does not itself extend that filing window or automatically remove conditions. Review the evidence required at the actual stage without promising an outcome. Conditional residence begins at immigrant admission or adjustment approval, not at investment or petition approval.
Decide between a regional-center project and a direct investment
Identify the project location, the rural or high-unemployment basis claimed, the relevant USCIS designation or project approval and its applicable dates. Determine whether the proposal is standalone or through a regional center and assess the appropriate job-creation method. In a regional centre project that role is usually structured through a limited partnership interest with defined rights. Job creation in regional-centre projects may be counted using economic models that include indirect jobs, but the ten-job requirement is per investor and depends on the project delivering. The documents that matter are the private placement memorandum, the subscription agreement, the escrow agreement, the job-creation methodology and the regional center's designation and compliance status. A regional-center investment may count indirect and induced jobs shown through an economic model, which is easier to reach but places the investor in a project whose job model, capital stack and timing are controlled by others. Within the ninety days before the second anniversary, Form I-829 must be filed showing the capital remained invested and the jobs were created or will be within a reasonable time. Read the offering documents for deployment, job allocation, redeployment, conflicts, and exit terms; a regional-center designation does not eliminate project-specific risk.
