Does the principal’s promotion give an L spouse a new employment-authorization period?

THE DIRECT ANSWER

Not automatically. The spouse’s valid status and applicable evidence govern the spouse’s work position; a corporate promotion notice is not a status document.

Check the family’s own immigration record

A qualifying L spouse may work incident to valid dependent status, while children do not receive that spouse permission. Review the most recent individual record, any pending process and the planned work. The principal’s change may require assessment without automatically changing every family member’s dates. Do not substitute the new employment contract term for the spouse’s authorized period. Dependent eligibility concerns an eligible spouse and unmarried children under 21; assess the individual status and authorized period.

Derivative status for a child depends on being unmarried and under 21, and both facts are tested continuously rather than only at admission, so a seventeen-year-old at the start of a seven-year maximum stay will not be a derivative at the end of it. Where a spouse intends to work, confirm what documentation an employer will expect to see before a start date is accepted, since the practical obstacle is usually proving the status rather than holding it.
