Do not assume a commercial delay changes the filing window. I-829 is generally filed during the 90 days before the second anniversary of conditional residence.
Keep the filing date separate from the project milestone
Use the actual conditional-residence record and obtain advice on the evidence and procedure required for the individual case. A revised completion date does not automatically extend status or eliminate the removal-of-conditions step. Preserve project updates and official communications, but do not wait for a developer’s preferred date while overlooking the investor’s immigration obligation.
If the closing tranche after tax and distribution meets the threshold for a targeted-employment-area project, the petition can be filed as soon as the path-of-funds evidence is assembled, which often takes longer than investors expect because early corporate records must be found. Records supporting job creation have to exist contemporaneously rather than being assembled at the end, so the reporting arrangement and the investor's entitlement to receive information should be settled at the point of investment rather than requested when the filing window approaches.
