ST. ALBERT · EB-5 FIELD GUIDE

Does a changed EB-5 project schedule automatically mean the investor fails the job requirement?

THE DIRECT ANSWER

No universal conclusion follows from a schedule change alone. Assess actual job evidence, the applicable rules and the immigration stage; do not treat the original forecast as completed results.

Review the requirements against current evidence

At least ten qualifying permanent full-time jobs per investor are required under the applicable rules, along with qualifying at-risk capital and management or policy-formulation participation. Current general investment thresholds are US$1,050,000 or a qualifying US$800,000, with adjustment beginning January 1, 2027. An existing case needs its own filing-date and project analysis. Avoid both a guarantee that every delay is harmless and an unsupported claim that every revised milestone is fatal.

In a regional-centre project the economic model can count indirect and induced jobs; in a direct case only the new commercial enterprise's own full-time employees count, so the machine shop must reach ten qualifying positions itself. Job creation is counted for qualifying U.S. workers and the ten is a floor rather than a target, calculated either directly or, in a regional-centre case, through an accepted economic methodology that the project must be willing to explain.
