Does paying an additional project charge automatically cure a gap in EB-5 job evidence?

THE DIRECT ANSWER

No. Determine what the payment is for and which requirement remains unmet. More money is not by itself evidence of qualifying jobs or a successful immigration outcome.

Separate additional costs from qualifying capital

Current general investment amounts are US$1,050,000 or a qualifying US$800,000, with statutory adjustment beginning January 1, 2027; an existing case requires its own applicable-rule assessment. Administrative, legal or project expenses are not automatically investment capital. Review actual amendment terms and financial risk before committing funds, and verify government fees separately.

Government filing charges at the investor-petition, immigrant-visa and removal-of-conditions stages, professional fees at each stage, business-plan and economic-support costs, document and translation costs, and the state dental-licensing process. Chiefly professional time and document retrieval: certified translations, archived bank statements, accountants' letters, valuations and additional legal hours spent reconciling records across jurisdictions. Government charges are a third line: the initial petition, later stages for the family, and the eventual petition to remove conditions each carry their own charge under the published schedule, and they should be confirmed at the time rather than quoted from an older document.
