SPRUCE GROVE · GOLD CARD FIELD GUIDE

Does buying a private product called a Gold Card investment establish eligibility for the government program?

THE DIRECT ANSWER

No. Identify the actual transaction and official process. A private product name or payment does not establish EB-1 or EB-2 eligibility, admissibility or visa availability.

Compare the proposal with the government framework

The official program describes a nonrefundable processing fee, vetting and a government gift after successful vetting. Its gift is not EB-5 capital offered for commercial return. Preserve the private proposal and identify any separate service or investment without assuming it substitutes for the government steps or guarantees immigration approval.

Under Executive Order 14351, the gift is treated as evidence of eligibility under specified EB-1 and EB-2 grounds; the current official FAQ separately requires the applicant to be eligible for lawful permanent resident status, admissible to the United States and have a visa available. An individual applicant such as a veterinarian in private practice may apply without an employer; the corporate route with its larger per-employee gift, annual maintenance and transfer terms is a separate track for sponsors. The published framework uses classifications that already exist within employment-based immigration, in the first and second preference categories, which means the requirements and procedures of the underlying category continue to matter and should be examined rather than skipped.
