Does paying for a more active project role replace any part of the EB-5 capital requirement?

THE DIRECT ANSWER

No automatic substitution follows. Separate the actual investment from service charges or compensation arrangements and assess the governing rights on their own terms.

Keep participation and funding requirements distinct

Current general capital amounts are US$1,050,000 or the qualifying US$800,000 threshold, subject to adjustment beginning January 1, 2027. Project, government and professional fees are separate and not automatically qualifying capital. A purchased title or an additional charge does not establish genuine policy participation, job creation or a successful immigration outcome.

Filing fees at more than one stage, published in the USCIS fee schedule; administrative or subscription fees where a pooled project is used; legal fees weighted toward the source-of-funds work; and professional costs for accountants, translators and diligence. Keep family-related expenses and independent financial diligence visible as separate line items, since an advertised package price can omit material terms while a quoted return does not describe the full financial exposure. Ask for a single written statement of every amount the investor will pay across the whole process, including amounts payable to third parties, and keep it beside the capital figure rather than merged into it.
