The L-1A new-office showing must establish support for the managerial or executive role within one year of petition approval. A distant staffing ambition does not replace that required showing.
Connect the first-year resources to the real role
A new office also needs sufficient physical premises and the qualifying foreign managerial or executive employment, alongside the corporate foundation. Initial approval is limited to one year. Use evidence supporting the actual first-year plan rather than assuming later growth automatically extends permission or cures unsupported managerial duties.
Share registers, payroll reconstruction and an honest organisation chart often take longer to produce than the petition takes to prepare, and the qualifying year abroad must already be complete before the petition is filed. A common error is transferring Canadian authority too early, then discovering the applicant no longer performs the documented foreign role while the American operation remains unable to support management. The condition is worth restating without hedging it away: the qualifying year must fall within the three years preceding the request, and time spent working in the United States for the same organization may affect how that window is counted.
