THE SHORT ANSWER

A Fort Saskatchewan household may plan a principal’s U.S. assignment, a spouse’s remote technical work and a child’s studies at the same time. Describe each activity and location before assuming that one principal’s application answers the entire family plan.

01

Identify the actual dependent category

Dependent eligibility generally concerns an eligible spouse and unmarried children under 21. TD permits study but not employment. Qualifying E and L spouses may work incident to valid status with the appropriate evidence, while children do not receive that spouse authorization. The principal’s approval alone is not the spouse’s admission or status record. Eligible TD, E and L dependents may study while maintaining their status; school enrolment does not extend that status, and immigrant CSPA rules do not extend temporary dependent eligibility.

02

Describe work without relying on payment labels

Identify what the person will do, where and for whom, including remote services or unpaid assistance to a family business. A Canadian payer, professional credential or ownership share is not itself U.S. work permission. Review the actual category and authorized dates before arranging technical reports, supplier work or management tasks.

03

Keep a permanent-residence plan separate

An EB-5 investment or Gold Card payment does not itself grant current work authorization or permanent residence. Assess actual immigrant eligibility and any derivative age issue on the case facts rather than treating an early payment as a universal age freeze. Family members travelling on immigrant visas must follow the relevant sequence with the principal entering first or together.

04

Use separate records for separate commitments

Keep school arrangements, employment proposals and immigration documents linked to the correct person. A school acceptance does not prove a spouse’s work permission, and a shareholder agreement does not prove a child’s status. Coordinate the move around actual permissions rather than turning the household’s preferred date into a legal conclusion.
