THE SHORT ANSWER

A hypothetical Fort Saskatchewan applicant may compare an EB-5 project employing workers with a philanthropic project connected to a Gold Card discussion. Identify the actual recipient and legal purpose before assuming that either form of public or economic benefit satisfies the other route.

01

Read the EB-5 capital and job requirements

Current general EB-5 thresholds are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure project, with statutory adjustments beginning January 1, 2027. Show lawful at-risk capital invested or actively being invested and at least ten qualifying permanent full-time jobs per investor under the applicable method. A project-wide hiring figure does not itself establish every investor’s allocation. Managerial or policy engagement also needs actual supporting rights.

02

Read the Gold Card gift terms

Current official terms provide US$15,000 nonrefundable processing per person, then after successful vetting a US$1 million individual principal gift or US$2 million gift per corporate-sponsored employee. Each intended eligible joining spouse or unmarried child under 21 adds US$15,000 and US$1 million, including corporately, and should be included initially. Corporate terms include 1% annual maintenance and 5% transfer with a new background check. A separate donation to a preferred public project is not automatically the instructed gift. A transfer does not automatically approve a replacement employee.

03

Compare the outcome and remaining obligations

Gold Card concerns EB-1 or EB-2 permanent residence as appropriately determined, subject to eligibility, admissibility and visa availability. EB-5 has its own conditional-residence process; I-829 is generally filed during the 90 days before the second anniversary of conditional residence. Neither a project’s announcement nor a recipient’s acknowledgement grants current work permission. Do not promise an investment return from the government gift or a tax outcome from the word donation. Conditional residence begins at immigrant admission or adjustment approval, not at investment or petition approval.
