Start with the TN eligibility and application overview
Describe the engineering judgment
Identify what the applicant evaluates, designs or decides, the relevant deliverables and how test results inform those decisions. Distinguish professional responsibility from routine tasks where the assignment includes both. Do not declare all hands-on testing ineligible, but do not assume that operating technical equipment makes every task professional engineering.
Establish the actual listed qualification
The TN Engineer entry permits a baccalaureate or licenciatura degree, or a state or provincial licence. Identify the actual credential and its relevance; a short technical course is not an additional listed alternative. Degrees from institutions outside Canada, Mexico and the United States require reliable foreign-credential evaluation. Separate the immigration qualification from any professional practice requirements applicable to the proposed work.
Confirm the whole professional arrangement
TN requires Canadian or Mexican citizenship, prearranged qualifying professional activity and temporary entry. The employer may be U.S. or foreign. Services to a U.S. entity solely owned or controlled by the applicant constitute prohibited TN self-employment; an assigned supervisor does not cure that ownership issue. A foreign business interest alone does not automatically disqualify the person. Explain the actual recipient, employer and ownership facts.
Decide which listed profession applies before translating anything
TN turns on the credential alternatives written into the specific profession's listing, not on a general notion of equivalency, so counsel should confirm which alternative the applicant is relying on before anything is drafted. Where the degree title and the profession diverge, those three records together decide whether the qualification is in the field, and a letter from the university confirming the economics concentration helps. If the American employer's offer is for a role that is really management, education or clinical informatics, the duties have moved away from the listed profession and a different analysis applies, even if only a nurse could do the job. A school’s new name neither supplies a missing qualification nor invalidates an otherwise relevant award; experience cannot universally replace the required education. Compare the transcript, award document and any evaluation with the precise listed occupation before commissioning extra evidence. If the credential is not in English, pair the translation with the underlying record and explain any difference between the diploma's field and the offered profession. A Canadian professional may request TN classification at a border inspection point or preclearance facility; if USCIS is the selected procedure, the U.S. employer files Form I-129 directly with that agency. Confirm as well that the letter describes the profession by the qualification actually relied on, since the profession-specific requirement is assessed against the person’s credentials rather than against the job title the company happens to use internally.
