Can the amount already raised from other investors replace my own EB-5 capital contribution?

THE DIRECT ANSWER

No. A project’s financing total is not proof of the capital qualifying in your individual case. Trace your own lawful contribution and applicable threshold.

Separate project resources from applicant capital

Current general thresholds are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure project, with statutory adjustment from January 1, 2027. Private project charges and official filing fees are separate costs, not automatically qualifying capital. A funded project does not itself prove that your required investment is made or actively being made.

Government filing fees for the investor petition, the immigrant visa or adjustment process, and later the petition to remove conditions, all published officially; plus regional centre administrative fees where applicable, legal fees, and professional work on source-of-funds documentation. Professional costs form a third line: U.S. immigration counsel, securities or corporate advice on the offering, an independent source-of-funds review, accountancy, certified translations, and any due diligence commissioned on the project. Build one schedule listing every payment: the qualifying capital, administrative or subscription fees, independent legal fees, financial review, translation, medical examinations, and travel, with the payee and the timing beside each.
