Can a spouse’s personal guarantee establish E-2 spousal work permission?

THE DIRECT ANSWER

A guarantee concerns financing; it does not create immigration status or work authorization.

Separate the financing and household records

Eligible E spouses are generally work-authorized incident to valid spousal status, which should be confirmed in the spouse’s own record. Unmarried children under 21 may qualify as dependants but do not receive employment permission from E dependent-child status. Signing loan documents is not the relevant permission milestone.

Until the family holds appropriate E status, the purchase option supplies no permission to manage staff, serve customers, sign routine contracts, or perform remote operational work from the United States. Each family member has their own application and eligibility, so approvals and appointments may not arrive together; schedule each worker according to their own applicable authorization, including any independent permission held. Do not confuse dependent permission with principal eligibility: investor and enterprise need treaty nationality, at least 50 percent treaty-national ownership, direction through ownership or operational control, and committed at-risk capital in a real, nonmarginal venture. If the investor plans U.S. development work, assess the necessary work authorization separately; owning or transferring intellectual property does not grant permission to perform that work in the United States.
